If you are using this Website on behalf of a business, organization, or other legal entity, you represent and warrant that you have the authority to bind such entity to these Terms, and "you" shall refer to both you individually and to that entity. We will not be liable for any loss, damage, or harm resulting from your failure to maintain the security of your account credentials. We reserve the right to terminate accounts, refuse service, or cancel orders at our sole discretion, particularly in cases where we believe account information is inaccurate, fraudulent, or in violation of these Terms.
4. User Obligations and Prohibited Activities
By using this Website, you agree to use it solely for lawful purposes and in a manner consistent with these Terms and all applicable laws and regulations. You acknowledge that the Website is provided for legitimate food service transactions and related purposes only.

5. Ordering, Payment, and Pricing
5.1 Order Placement
When you place an order through our Website, you are making an offer to purchase the items selected at the prices stated. We reserve the right to accept or reject your order at our discretion. An order confirmation sent to your email address does not constitute our acceptance of the order; acceptance occurs when your order is prepared or dispatched for delivery.
You are responsible for reviewing your order carefully before submission. Once an order has been submitted and confirmed, modifications may be limited depending on the stage of preparation. Please contact us immediately if you need to make changes to a recently placed order.
5.2 Pricing and Taxes
All prices displayed on the Website are in United States Dollars (USD) and are subject to applicable federal, state, and local taxes, which will be calculated and displayed during the checkout process. Prices may vary by location and are subject to change without notice. In the event of a pricing error, we reserve the right to cancel the order and notify you accordingly.
5.3 Payment Methods
We accept various forms of payment as indicated during the checkout process. By providing payment information, you represent and warrant that you are authorized to use the designated payment method and that the information you provide is accurate and complete. You authorize us to charge the applicable amounts to your provided payment method.
All payment transactions are processed through secure third-party payment processors. We do not store full payment card information on our servers. Our payment processing partners are required to comply with applicable security standards, including the Payment Card Industry Data Security Standard (PCI DSS).
5.4 Refunds and Cancellations
If you are unsatisfied with your order due to a verified error on our part, such as missing items, incorrect items, or quality issues, please contact us at [email protected] within a reasonable timeframe of receiving your order. Refunds or replacements will be issued at our sole discretion on a case-by-case basis. We are not obligated to provide refunds for orders where customer preferences were the reason for dissatisfaction once the order has been correctly fulfilled per the specifications submitted.
6. Delivery and Carryout
Delivery services are subject to availability based on your geographic location and may be subject to minimum order requirements and delivery fees. Estimated delivery times are provided as approximations only and are not guaranteed. Various factors, including weather conditions, traffic, and order volume, may affect actual delivery times.
You are responsible for providing accurate and complete delivery address information. We shall not be liable for failed deliveries resulting from inaccurate or incomplete address information provided by you. If a delivery cannot be completed due to circumstances within your control, additional charges may apply for redelivery attempts.
Risk of loss and title for food items pass to you upon delivery or upon your taking possession at the carryout location, as applicable.
7. Intellectual Property Rights
All content on this Website, including but not limited to text, graphics, logos, images, photographs, audio clips, digital downloads, data compilations, software, and the overall design and compilation of the Website (collectively, "Content"), is the exclusive property of Imos Pizza or its licensors and is protected by applicable United States and international intellectual property laws, including copyright law under the Copyright Act, 17 U.S.C. § 101 et seq., trademark law, and other applicable laws.
The Imos Pizza name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Imos Pizza or its affiliates. You may not use any such marks without our prior written consent. All other trademarks, service marks, and trade names appearing on this Website are the property of their respective owners.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Website and its Content solely for personal, non-commercial purposes in connection with using our food ordering services. This license does not include the right to:
- Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Website or its Content;
- Modify or create derivative works based on the Website or its Content;
- Use any meta tags or other hidden text using our name or trademarks without our express written consent;
- Frame or mirror any portion of the Website without our express written authorization;
- Use any data mining, robots, or similar data gathering and extraction tools.
Any use of the Website or its Content not expressly permitted by these Terms is a breach of these Terms and may violate copyright, trademark, and other applicable laws, potentially resulting in legal liability.
8. User-Generated Content
If you submit reviews, comments, feedback, photographs, or other content to the Website or to any associated social media platforms ("User Content"), you grant Imos Pizza a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content throughout the world in any media.
You represent and warrant that you own or otherwise control all rights to the User Content you submit, that the content is accurate, and that use of the content you provide will not violate these Terms or cause injury to any person or entity. We take no responsibility for User Content and reserve the right to remove any User Content at our sole discretion.
9. Disclaimers and "As-Is" Basis

- WARRANTIES REGARDING THE ACCURACY, COMPLETENESS, TIMELINESS, OR RELIABILITY OF ANY CONTENT ON THE WEBSITE;
- WARRANTIES THAT THE WEBSITE WILL BE UNINTERRUPTED, ERROR-FREE, VIRUS-FREE, OR SECURE;
- WARRANTIES REGARDING THE RESULTS OBTAINED FROM USE OF THE WEBSITE OR SERVICES;
- WARRANTIES OF NON-INFRINGEMENT OF THIRD-PARTY RIGHTS.
WHILE WE MAKE REASONABLE EFFORTS TO PROVIDE ACCURATE NUTRITIONAL, ALLERGEN, AND INGREDIENT INFORMATION, WE DO NOT WARRANT THAT SUCH INFORMATION IS COMPLETE OR ERROR-FREE. CUSTOMERS WITH FOOD ALLERGIES, INTOLERANCES, OR SPECIFIC DIETARY REQUIREMENTS ARE STRONGLY ADVISED TO CONTACT US DIRECTLY BEFORE PLACING AN ORDER. OUR FOOD PRODUCTS ARE PREPARED IN KITCHENS WHERE ALLERGENS ARE PRESENT, AND CROSS-CONTAMINATION MAY OCCUR.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL IMOS PIZZA, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, SERVICE PROVIDERS, SUCCESSORS, OR ASSIGNS BE LIABLE FOR ANY:
- INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES;
- LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITIES;
- PERSONAL INJURY OR PROPERTY DAMAGE ARISING FROM YOUR USE OF OR INABILITY TO USE THE WEBSITE OR ITS SERVICES;
- UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN;
- BUGS, VIRUSES, TROJAN HORSES, OR THE LIKE THAT MAY BE TRANSMITTED TO OR THROUGH THE WEBSITE BY THIRD PARTIES;
- ERRORS OR OMISSIONS IN ANY CONTENT ON THE WEBSITE;
- DELAYS OR DISRUPTIONS IN SERVICE.
IN JURISDICTIONS WHERE LIMITATIONS ON LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES ARE NOT PERMITTED, OUR LIABILITY SHALL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY LAW. IN ALL CASES, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER OR RELATED TO THESE TERMS SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100.00 USD).
11. Indemnification
You agree to defend, indemnify, and hold harmless Imos Pizza and its respective officers, directors, employees, contractors, agents, licensors, service providers, successors, and assigns from and against any and all claims, liabilities, damages, judgments, awards, losses, costs, expenses, and fees (including reasonable attorneys' fees) arising out of or relating to:
- Your violation of these Terms of Service;
- Your use of the Website or our services in a manner not authorized by these Terms;
- Your violation of any applicable law, rule, or regulation, including but not limited to consumer protection laws enforced by the Federal Trade Commission;
- Your infringement of any intellectual property or other rights of any third party;
- Any User Content you submit, post, transmit, or make available through the Website;
- Your negligence or willful misconduct;
- Any misrepresentation made by you in connection with your use of the Website.
We reserve the right, at our expense, to assume the exclusive defense and control of any matter subject to indemnification by you, in which event you agree to cooperate fully with us in asserting any available defenses. You agree not to settle any claim subject to indemnification without our prior written consent.
12. Privacy Policy
Your use of this Website is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Our Privacy Policy describes how we collect, use, disclose, and protect your personal information. By using the Website, you consent to our collection and use of your information as described in the Privacy Policy.
To the extent applicable, and depending on your state of residence, you may have rights under:
- The California Consumer Privacy Act (CCPA) as amended by the California Privacy Rights Act (CPRA), if you are a California resident;
- Other applicable state privacy laws;
- The Federal Trade Commission Act (FTC Act), 15 U.S.C. § 45, governing unfair or deceptive acts and practices.
For any privacy-related inquiries, please contact us at [email protected].
13. Governing Law and Jurisdiction
These Terms of Service and any dispute, claim, or controversy arising out of or relating to these Terms, your use of the Website, or our services shall be governed by and construed in accordance with the laws of the United States of America and the laws of the state in which our principal place of business is located, without regard to conflict of law principles.
Subject to the dispute resolution provisions set forth in Section 14 below, you agree to submit to the exclusive personal jurisdiction of the federal and state courts located within the applicable jurisdiction in the United States for the resolution of any disputes not subject to arbitration. You waive any objection to the laying of venue in such courts and waive any claim that such courts constitute an inconvenient forum.
Nothing in these Terms shall limit our right to seek injunctive or other equitable relief in any court of competent jurisdiction in connection with any breach or threatened breach of these Terms that may cause irreparable harm to Imos Pizza.
14. Dispute Resolution
14.1 Informal Resolution
Before initiating any formal dispute resolution proceeding, you agree to first attempt to resolve any dispute, claim, or controversy arising from or related to these Terms or your use of the Website informally by contacting us at [email protected]. We will attempt to resolve the dispute informally within thirty (30) days of receiving your notice. If we are unable to resolve the dispute informally within that period, either party may proceed to formal dispute resolution as described below.
14.2 Binding Arbitration
Except for disputes that qualify for small claims court, any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, or the use of the Website or services, shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, which are available at www.adr.org. The arbitration shall be conducted in the English language.
The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this arbitration agreement. The arbitrator's award shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
YOU AND IMOS PIZZA EACH WAIVE THE RIGHT TO TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION OR CLASS ARBITRATION. ALL DISPUTES MUST BE BROUGHT IN THE PARTIES' INDIVIDUAL CAPACITIES AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
14.3 Small Claims Court
Notwithstanding the foregoing, either party may bring an individual action in small claims court for disputes within the applicable jurisdictional limits, provided the claim remains in small claims court and does not seek class or representative relief.
14.4 Waiver of Class Actions
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, YOU WAIVE ANY RIGHT TO PARTICIPATE AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING AGAINST IMOS PIZZA. UNLESS IMOS PIZZA AGREES OTHERWISE IN WRITING, THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF CLASS OR REPRESENTATIVE PROCEEDING.
15. Term and Termination
These Terms shall remain in full force and effect while you use the Website or maintain an account with us. We reserve the right, in our sole discretion and without prior notice, to:
- Suspend or terminate your access to the Website and your account for any reason, including violation of these Terms;
- Refuse service to any person or entity at any time for any reason;
- Cancel or refuse any orders suspected to be fraudulent or in violation of these Terms;
- Discontinue or modify any aspect of the Website or our services.
Upon termination of your account or access, your right to use the Website and its services will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including but not limited to: intellectual property provisions, disclaimers, limitation of liability, indemnification, dispute resolution, and governing law provisions.
You may terminate your account at any time by contacting us at [email protected] and requesting account deletion. Please note that certain information may be retained as required by applicable law or for legitimate business purposes.
16. Third-Party Links and Services
The Website may contain links to third-party websites, services, or resources that are not owned or controlled by Imos Pizza. These links are provided solely as a convenience. We have no control over the content, privacy policies, or practices of any third-party website and assume no responsibility for their content, accuracy, or availability.
We do not endorse any products, services, or information offered by third-party websites linked to or from our Website. You acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with your use of or reliance on any third-party content, goods, or services.
We strongly advise you to review the terms and privacy policies of any third-party websites you visit, including any third-party payment processors, delivery platforms, or social media platforms associated with our services.
17. Changes to Terms of Service
We reserve the right to modify, update, revise, or replace these Terms of Service at any time at our sole discretion. When we make material changes to these Terms, we will update the "Last Updated" date at the top of this page and, where appropriate, notify you by:
- Posting a prominent notice on our Website;
- Sending an email notification to the address associated with your account;
- Any other means we deem appropriate.
Your continued use of the Website following the posting of revised Terms constitutes your acceptance of and agreement to the updated Terms. If you do not agree to the revised Terms, you must stop using the Website and, if applicable, close your account. We encourage you to review these Terms regularly to remain informed of any updates.
We may also revise these Terms to reflect changes in applicable law, including changes to the California Consumer Privacy Act (CCPA/CPRA), Federal Trade Commission regulations, or other relevant federal or state legislation affecting our business operations.
18. Severability
If any provision of these Terms of Service is held by a court of competent jurisdiction or arbitrator to be invalid, illegal, void, unenforceable, or contrary to applicable law, such provision shall be deemed severed from these Terms. The remaining provisions of these Terms shall continue in full force and effect and shall be construed in such a way as to give effect to the original intent of the parties to the maximum extent possible.
The invalidity or unenforceability of any particular provision of these Terms shall not affect the validity or enforceability of any other provision. If a court determines that any provision is invalid, illegal, or unenforceable, it may modify such provision to the minimum extent necessary to make it valid and enforceable in accordance with applicable law.
No waiver by Imos Pizza of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition, and any failure by Imos Pizza to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
19. Entire Agreement
These Terms of Service, together with our Privacy Policy and any other legal notices or agreements published by us on the Website, constitute the entire agreement between you and Imos Pizza with respect to your use of the Website and our services. These Terms supersede all prior and contemporaneous agreements, representations, warranties, and understandings, whether written or oral, between you and Imos Pizza regarding the subject matter hereof.
No oral modification of these Terms shall be binding. Any modification must be made in writing and duly executed by an authorized representative of Imos Pizza to be valid and enforceable.
20. No Waiver
The failure of Imos Pizza to enforce any right or provision of these Terms shall not be construed as a waiver of such right or provision. A waiver of any default shall not constitute a waiver of any subsequent default of the same or a different kind. All waivers must be explicit and in writing to be effective.
21. Force Majeure
Imos Pizza shall not be liable for any delay or failure to perform its obligations under these Terms to the extent that such delay or failure is caused by events beyond our reasonable control, including but not limited to acts of God, natural disasters, epidemics or pandemics, fires, floods, earthquakes, governmental actions or restrictions, war, terrorism, labor disputes, power outages, internet outages, third-party service failures, or any other event constituting force majeure under applicable law.
In such circumstances, we will use commercially reasonable efforts to resume performance as soon as practicable and will notify customers of material disruptions to service through our Website or by email where feasible.
22. Accessibility
We are committed to making our Website accessible to all users, including individuals with disabilities. We strive to comply with applicable accessibility standards, including the Web Content Accessibility Guidelines (WCAG). If you experience difficulty accessing any content or functionality on our Website, please contact us at [email protected] so we can provide assistance or make necessary accommodations.
23. Electronic Communications
By using this Website and providing your email address or other contact information, you consent to receive electronic communications from us, including order confirmations, account notifications, and promotional messages (where you have opted in). You acknowledge that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing, to the fullest extent permitted by applicable law, including the Electronic Signatures in Global and National Commerce Act (E-SIGN Act), 15 U.S.C. § 7001 et seq.
You may opt out of receiving promotional electronic communications at any time by following the unsubscribe instructions contained in such messages or by contacting us at [email protected].
